       AN ACT to amend the public officers law, in relation to  the  rights  of
         associations  of  retirees  of  a  public  retirement system to obtain
         certain information concerning officers, employees or retirees
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1. Subdivision 7 of section 89 of the public officers law, as
    2  added by chapter 783 of the laws of 1983, is amended to read as follows:
    3    7. Nothing in this article shall require the disclosure  of  the  home
    4  address  of  an officer or employee, former officer or employee, or of a
    5  retiree of a public employees' retirement system; nor shall anything  in
    6  this  article  require  the  disclosure of the name or home address of a
    7  beneficiary of a public employees' retirement system or of an  applicant
    8  for  appointment to public employment; [provided] however, [that nothing
    9  in this subdivision shall limit or abridge the  right  of]  an  employee
   10  organization,  certified  or  recognized  for any collective negotiating
   11  unit of an employer pursuant to article fourteen of  the  civil  service
   12  law[,  to  obtain  the  name or home address of any officer, employee or
   13  retiree of such employer, if such name  or  home  address  is  otherwise
   14  available under this article] OR AN ASSOCIATION OF RETIREES OF A VALIDLY
   15  RECOGNIZED  AND  OPERATED PUBLIC RETIREMENT SYSTEM ESTABLISHED UNDER THE
   16  NOT-FOR-PROFIT CORPORATION LAW SHALL HAVE THE RIGHT TO OBTAIN  THE  NAME
   17  OR  HOME ADDRESS OF ANY OFFICER, EMPLOYEE OR RETIREE OF SUCH EMPLOYER OR
   18  SUCH SYSTEM. IN NO EVENT, HOWEVER, SHALL SUCH  ORGANIZATION  OR  ASSOCI-
   19  ATION  DISTRIBUTE  OR MAKE AVAILABLE DIRECTLY OR INDIRECTLY TO ANY THIRD
   20  PARTY OR PARTIES ANY NAME OR ADDRESS OF ANY OFFICER, EMPLOYEE OR RETIREE
   21  OBTAINED PURSUANT TO THIS SUBDIVISION.
   22    S 2. This act shall take effect immediately.
