          GALLAHAN, LEMONDES, DeSTEFANO, TAGUE -- read once and referred to  the
          Committee on Housing

        AN  ACT to amend the private housing finance law, in relation to prefer-
          ences under the affordable  home  ownership  development  program  for
          service related disabled veterans

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Paragraph (a) of subdivision  3  of  section  1112  of  the
     2  private  housing  finance  law, as amended by chapter 898 of the laws of
     3  1986, is amended to read as follows:
     4    (a) Serve the lowest income households in the applicable region and is
     5  designed to continue to be affordable to such households for a  substan-
     6  tial  period of time[.] or serve households in which the home buyer is a
     7  service related disabled veteran.
     8    For purposes of this section, "service related disabled veteran" shall
     9  mean a person (i) who served in  the  active  military,  naval,  or  air
    10  service, or who was a recipient of the armed forces expeditionary medal,
    11  navy  expeditionary  medal,  marine corps expeditionary medal, or global
    12  war on terrorism expeditionary medal, and who was discharged or released
    13  therefrom under honorable conditions, (ii) has been awarded a disability
    14  rating of forty percent or higher from the  federal  veteran's  adminis-
    15  tration  or  from  the  United  States department of defense, where that
    16  disability was incurred in line of duty in the active military, naval or
    17  air service, as documented according to  rules  and  regulations  to  be
    18  promulgated by the division.
    19    §  2.  This  act shall take effect on the thirtieth day after it shall
    20  have become a law.
