       AN  ACT  to  amend  the public authorities law, in relation to contracts
         entered into by the metropolitan transportation authority
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Paragraph  (a)  of  subdivision  6 of section 1265 of the
    2  public authorities law, as amended by chapter 988 of the laws  of  1984,
    3  is amended to read as follows:
    4    (a)  To enter into contracts and leases and to execute all instruments
    5  necessary or convenient; PROVIDED, HOWEVER:
    6    (I) THAT CONTRACTS FOR THE LEASE OF ANY RAILROAD FACILITIES  SHALL  BE
    7  FOR A TERM NO LONGER THAN TWENTY YEARS; AND
    8    (II) ANY LESSEE SEEKING TO RENEW A CONTRACT FOR THE LEASE OF ANY RAIL-
    9  ROAD  FACILITIES  WHO  HAS  COMMITTED  MORE THAN THREE VIOLATIONS OF ANY
   10  PERMIT ISSUED PURSUANT TO SECTION 27-0305 OF THE ENVIRONMENTAL CONSERVA-
   11  TION LAW, SHALL BE BARRED FROM SUCH RENEWAL;
   12    S 2. This act shall take effect immediately.
