       AN ACT to amend the alcoholic  beverage  control  law,  in  relation  to
         prohibiting  the  granting of a license for the retail sale of alcohol
         beverages for on-premises or off-premises consumption to any  premises
         upon which there exists a drive-up or drive-through facility
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Section 105  of  the  alcoholic  beverage  control  law  is
    2  amended by adding a new subdivision 4 to read as follows:
    3    4.  NO  RETAIL  LICENSE TO SELL ALCOHOLIC BEVERAGES FOR ON-PREMISES OR
    4  OFF-PREMISES CONSUMPTION SHALL BE GRANTED FOR ANY  PREMISES  UPON  WHICH
    5  THERE EXISTS A DRIVE-UP OR DRIVE-THROUGH FACILITY.
    6    S  2.  This  act  shall  take  effect  immediately, and shall apply to
    7  licenses issued or renewed on or after such date.
