        AN ACT to amend the labor law, in relation to establishing a  claim  for
          fraudulent inducement to enter into an employment relationship

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. The labor law is amended by adding a new section  198-f  to
     2  read as follows:
     3    §  198-f. Fraudulent inducement prohibited. 1. No employer shall know-
     4  ingly make any false or misleading statement regarding wages,  benefits,
     5  or wage supplements to any person with intent to induce such person into
     6  entering or remaining in an employment relationship.
     7    2. If any employee has been fraudulently induced by his or her employ-
     8  er  to  enter  into  or  remain in an employment relationship, he or she
     9  shall recover in a civil action all damages incurred in reliance on such
    10  fraudulent inducement, together with  costs  and  reasonable  attorney's
    11  fees,  prejudgment interest as required under the civil practice law and
    12  rules, and an additional amount  as  liquidated  damages  equal  to  one
    13  hundred percent of the total amount of such reliance damages.
    14    § 2. This act shall take effect immediately.
