       AN  ACT to amend the vehicle and traffic law, in relation to prohibiting
         the operation of a motor vehicle with an animal in the front  seat  or
         an unrestrained animal in the vehicle
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. The vehicle and traffic law is  amended  by  adding  a  new
    2  section 1229-e to read as follows:
    3    S 1229-E. OPERATION OF VEHICLES WITH ANIMALS. 1. NO PERSON SHALL OPER-
    4  ATE A MOTOR VEHICLE IN THIS STATE WITH AN ANIMAL IN THE FRONT SEAT.
    5    2.  (A)  NO PERSON SHALL OPERATE A MOTOR VEHICLE IN THIS STATE WITH AN
    6  ANIMAL IN THE VEHICLE UNLESS SUCH ANIMAL IS RESTRAINED.
    7    (B) FOR THE PURPOSES OF THIS SECTION, A  RESTRAINED  ANIMAL  MEANS  AN
    8  ANIMAL  SECURED IN A HARNESS OR VEHICLE SEAT, CONFINED IN A BOX, OR HARD
    9  OR SOFT SIDED TRAVEL CRATE.
   10    3. ANY PERSON WHO VIOLATES THE PROVISIONS OF SUBDIVISION ONE OR TWO OF
   11  THIS SECTION SHALL BE PUNISHED BY A CIVIL FINE OF UP TO FIFTY DOLLARS.
   12    S 2. This act shall take effect immediately.
