       AN ACT to amend the general business law, in relation to  requiring  all
         cellular telecommunications service providers with new cellular anten-
         na towers to secure on-site back-up power
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. The general business law is amended by adding a new section
    2  390-d to read as follows:
    3    S 390-D. ON-SITE BACK-UP POWER SOURCE REQUIRED FOR NEW CELLULAR ANTEN-
    4  NA TOWERS. ON OR BEFORE JANUARY FIRST, TWO THOUSAND SIXTEEN, EACH CELLU-
    5  LAR TELECOMMUNICATIONS SERVICE PROVIDER  WITH  A  NEW  CELLULAR  ANTENNA
    6  TOWER  SHALL  EQUIP  SUCH  TOWER  WITH  ON-SITE BACK-UP POWER CAPABLE OF
    7  PROVIDING ELECTRICAL POWER CONTINUOUSLY FOR  A  MINIMUM  OF  SEVENTY-TWO
    8  HOURS TO BE USED DURING A POWER FAILURE.
    9    S 2. This act shall take effect immediately.
