       AN ACT to amend the alcoholic  beverage  control  law,  in  relation  to
         prohibiting  the sale of beer and wine products at retail for consump-
         tion off the premises between midnight and six o'clock in the morning
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  The alcoholic beverage control law is amended by adding a
    2  new section 105-d to read as follows:
    3    S 105-D. PROHIBITION ON THE RETAIL SALE OF BEER AND WINE PRODUCTS  FOR
    4  CONSUMPTION  OFF  THE PREMISES DURING CERTAIN HOURS. EXCEPT AS OTHERWISE
    5  PROVIDED BY SECTION ONE HUNDRED FIVE-A OF THIS ARTICLE, NO PERSON, FIRM,
    6  CORPORATION, LIMITED  LIABILITY  COMPANY,  OR  OTHER  ENTITY  HOLDING  A
    7  LICENSE TO SELL BEER AT RETAIL FOR CONSUMPTION OFF THE PREMISES PURSUANT
    8  TO  SECTION FIFTY-FOUR OF THIS CHAPTER OR HOLDING A LICENSE TO SELL BEER
    9  AND WINE PRODUCTS AT RETAIL FOR CONSUMPTION OFF THE PREMISES PURSUANT TO
   10  SECTION FIFTY-FOUR-A OF THIS CHAPTER SHALL SELL, OFFER FOR SALE, OR GIVE
   11  AWAY BEER OR WINE PRODUCTS AT RETAIL BETWEEN  TWELVE  MIDNIGHT  AND  SIX
   12  O'CLOCK ANTE MERIDIEM.
   13    S  2.  This  act shall take effect on the thirtieth day after it shall
   14  have become a law.
