BRODSKY -- read once and referred to the Commit- tee on Economic Development, Job Creation, Commerce and Industry AN ACT to amend the alcoholic beverage control law, in relation to prohibiting the sale of beer and wine products at retail for consump- tion off the premises between midnight and six o'clock in the morning THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. The alcoholic beverage control law is amended by adding a 2 new section 105-d to read as follows: 3 S 105-D. PROHIBITION ON THE RETAIL SALE OF BEER AND WINE PRODUCTS FOR 4 CONSUMPTION OFF THE PREMISES DURING CERTAIN HOURS. EXCEPT AS OTHERWISE 5 PROVIDED BY SECTION ONE HUNDRED FIVE-A OF THIS ARTICLE, NO PERSON, FIRM, 6 CORPORATION, LIMITED LIABILITY COMPANY, OR OTHER ENTITY HOLDING A 7 LICENSE TO SELL BEER AT RETAIL FOR CONSUMPTION OFF THE PREMISES PURSUANT 8 TO SECTION FIFTY-FOUR OF THIS CHAPTER OR HOLDING A LICENSE TO SELL BEER 9 AND WINE PRODUCTS AT RETAIL FOR CONSUMPTION OFF THE PREMISES PURSUANT TO 10 SECTION FIFTY-FOUR-A OF THIS CHAPTER SHALL SELL, OFFER FOR SALE, OR GIVE 11 AWAY BEER OR WINE PRODUCTS AT RETAIL BETWEEN TWELVE MIDNIGHT AND SIX 12 O'CLOCK ANTE MERIDIEM. 13 S 2.
