STATE OF NEW YORK ________________________________________________________________________ 5293 2023-2024 Regular Sessions IN ASSEMBLY March 7, 2023 ___________ Introduced by M. of A. NORRIS -- read once and referred to the Committee on Election Law AN ACT to amend the election law, in relation to the early voting period The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 1 of section 8-600 of the election law, as 2 added by chapter 6 of the laws of 2019, is amended to read as follows: 3 1. [Beginning] Early voting shall be held on the tenth day, seventh 4 day, fifth day, third day, and second day prior to any general, primary, 5 run-off primary or special election for public office or party position, 6 except for any general election held in a year in which electors of 7 president and vice president of the United States are to be elected and 8 for such an election held pursuant to title two of article six or arti- 9 cle fifteen of this chapter. In each year in which electors of president 10 and vice president of the United States are to be elected early voting 11 shall begin on the tenth day prior to [any] the general[, primary, run-12off primary pursuant to subdivision one of section 6-162 of this chapter13or special] election for any public or party position except for such an 14 election held pursuant to title two of article six or article fifteen of 15 this chapter, and [ending] end on and [including] include the second day 16 prior to such general[, primary, run-off primary or special] election 17 for such public office or party position[, persons]. Persons duly regis- 18 tered and eligible to vote at such election shall be permitted to vote 19 as provided in this title. The board of elections shall establish proce- 20 dures, subject to approval of the state board of elections, to ensure 21 that persons who vote during the early voting period shall not be 22 permitted to vote subsequently in the same election. 23 § 2.
