       AN ACT to amend the vehicle and traffic law, in  relation  to  an  erro-
         neously issued parking violation summons
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Section 1200 of the vehicle and traffic law is  amended  by
    2  adding a new subdivision (e) to read as follows:
    3    (E)  WHERE  A  COURT  OR  HEARING  OFFICER  DETERMINES  THAT A PARKING
    4  VIOLATION SUMMONS WAS ERRONEOUSLY ISSUED DUE TO NO FAULT OF  THE  PERSON
    5  RECEIVING  SUCH  SUMMONS  AND  IS  DISMISSED  BECAUSE THE DRIVER DID NOT
    6  VIOLATE ANY LAW, THE COURT SHALL ISSUE A ONE HUNDRED DOLLAR  PAYMENT  TO
    7  THE PERSON WHO WAS ISSUED THE TICKET.
    8    S  2.  This  act  shall take effect on the sixtieth day after it shall
    9  have become a law.
