       AN  ACT  to  amend the elder law, in relation to establishing the mature
         work task force, and providing for its powers and duties
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Legislative  findings  and intent. The legislature hereby
    2  finds and declares that the demographic projections are showing  clearly
    3  that older workers will continue to make up a rapidly growing percentage
    4  of  the  work force. This growth represents the fact that the population
    5  as a whole is getting older due to several factors, including the  aging
    6  of  the  baby  boom  generation, lower birth rates for generations imme-
    7  diately following the baby boom, longer life  expectancies  and  younger
    8  generations  leaving  the  state  to  work  elsewhere.  The  legislature
    9  believes efforts must  be  undertaken  to  identify  priorities,  policy
   10  alternatives  and  emerging  issues with respect to assisting both busi-
   11  nesses and older New Yorkers in preparing for the impact of this tremen-
   12  dous demographic shift. The legislature therefore establishes the mature
   13  worker task force to ensure a coordination of public and private efforts
   14  to address the needs of the growing numbers of older workers and to help
   15  allocate resources as necessary. This newly established task force shall
   16  be comprised of appropriate state agency personnel,  as  well  as  aging
   17  advocates,  mature  workers  ages  fifty-five  and older, senior service
   18  providers, employment training specialists, and representatives of labor
   19  and business interests.
   20    S 2. The elder law is amended by adding a new article  3  to  read  as
   21  follows:

    3  SECTION 301. DEFINITIONS.
    4          302. MATURE WORKER TASK FORCE.
    5          303. POWERS AND DUTIES.
    6          304. IMPLEMENTATION.
    7    S  301.  DEFINITIONS. FOR THE PURPOSES OF THIS ARTICLE, THE TERM "TASK
    8  FORCE" SHALL MEAN THE MATURE WORKER TASK FORCE  ESTABLISHED  BY  SECTION
    9  THREE HUNDRED TWO OF THIS ARTICLE.
   10    S 302. MATURE WORKER TASK FORCE. 1. THERE IS HEREBY ESTABLISHED WITHIN
   11  THE  OFFICE FOR THE AGING A MATURE WORKER TASK FORCE. THE PURPOSE OF THE
   12  TASK FORCE SHALL BE TO COORDINATE THE STATE'S EFFORTS  TO  ASSIST  OLDER
   13  PERSONS  WHO  CHOOSE TO WORK AND REMAIN SELF-SUFFICIENT THROUGHOUT THEIR
   14  LIVES, OR WHO CHOOSE TO  WORK  AFTER  RETIREMENT;  TO  SUPPORT  BUSINESS
   15  GROWTH AND DEVELOPMENT ACROSS THE STATE IN LIGHT OF THE INCREASING AGING
   16  WORKFORCE; AND TO COMBAT AGEISM AND STEREOTYPES.
   17    2.  THE  TASK  FORCE  SHALL  BE  COMPOSED  OF  TWENTY-SEVEN MEMBERS AS
   18  FOLLOWS:
   19    (A) NINE EX-OFFICIO MEMBERS AS FOLLOWS:
   20    (1) THE DIRECTOR OF THE OFFICE FOR  THE  AGING,  WHO  SHALL  SERVE  AS
   21  CO-CHAIR OF THE TASK FORCE;
   22    (2) THE COMMISSIONER OF LABOR, WHO SHALL SERVE AS CO-CHAIR OF THE TASK
   23  FORCE;
   24    (3) THE COMMISSIONER OF EDUCATION;
   25    (4) THE COMMISSIONER OF MENTAL HEALTH;
   26    (5) THE PRESIDENT OF THE STATE CIVIL SERVICE COMMISSION;
   27    (6) THE CHAIR OF THE SENATE AGING COMMITTEE;
   28    (7) THE CHAIR OF THE SENATE LABOR COMMITTEE;
   29    (8) THE CHAIR OF THE ASSEMBLY AGING COMMITTEE; AND
   30    (9) THE CHAIR OF THE ASSEMBLY LABOR COMMITTEE.
   31    ANY  EX-OFFICIO MEMBER MAY DESIGNATE A REPRESENTATIVE TO ACT ON HIS OR
   32  HER BEHALF;
   33    (B) TWO MEMBERS APPOINTED BY THE  GOVERNOR,  WHO  SHALL  BE  REPRESEN-
   34  TATIVES OF NOT-FOR-PROFIT CORPORATIONS THE PRIMARY PURPOSES OF WHICH ARE
   35  TO  PROVIDE  EMPLOYMENT SERVICES TO OLDER PERSONS AND SPECIFICALLY SERVE
   36  THEM IN THEIR EFFORTS TO DEVELOP THE REQUISITE SKILLS FOR AN EVER CHANG-
   37  ING JOB MARKET;
   38    (C) TWO MEMBERS APPOINTED BY THE  GOVERNOR,  WHO  SHALL  BE  REPRESEN-
   39  TATIVES OF ORGANIZATIONS REPRESENTING BUSINESS INTERESTS;
   40    (D)  FIVE  MEMBERS APPOINTED BY THE TEMPORARY PRESIDENT OF THE SENATE,
   41  OF WHOM ONE SHALL BE A REPRESENTATIVE OF ORGANIZED LABOR, ONE SHALL BE A
   42  RESEARCH EXPERT IN THE FIELD OF OLDER WORKER EMPLOYMENT ISSUES  AND  ONE
   43  SHALL BE A MATURE WORKER;
   44    (E) FIVE MEMBERS APPOINTED BY THE SPEAKER OF THE ASSEMBLY, OF WHOM ONE
   45  SHALL  BE  A  REPRESENTATIVE OF ORGANIZED LABOR, ONE SHALL BE A RESEARCH
   46  EXPERT IN THE FIELD OF OLDER WORKER EMPLOYMENT ISSUES AND ONE SHALL BE A
   47  MATURE WORKER;
   48    (F) TWO MEMBERS APPOINTED BY THE MINORITY LEADER OF THE SENATE; AND
   49    (G) TWO MEMBERS APPOINTED BY THE MINORITY LEADER OF THE ASSEMBLY.
   50    3. THE ADMINISTRATIVE SUPPORT OF  THE  TASK  FORCE  SHALL  BE  EQUALLY
   51  PROVIDED BY THE OFFICE FOR THE AGING AND THE DEPARTMENT OF LABOR.
   52    S  303.    POWERS  AND DUTIES. THE TASK FORCE SHALL HAVE THE FOLLOWING
   53  POWERS AND DUTIES:
   54    1. TO FACILITATE INTERAGENCY  PLANNING  AND  POLICY,  REVIEW  SPECIFIC
   55  AGENCY  INITIATIVES  FOR  THEIR IMPACT ON MATURE WORKERS AND BUSINESSES,
   56  PROVIDE A CONTINUING FORUM TO DISCUSS CONCERNS AND ISSUES RELATED TO THE

    1  FORMULATION OF STATE POLICY DESIGNED TO HELP ADDRESS THIS  POLICY  AREA,
    2  AND  DEVELOP  LINKAGES AND PARTNERSHIPS WITH BUSINESSES AND OTHER APPRO-
    3  PRIATE ENTITIES TO ASSIST SUCH BUSINESSES  IN  IDENTIFYING  AND  HELPING
    4  THEM TO FILL THEIR WORKFORCE NEEDS;
    5    2. TO IDENTIFY EXISTING STATUTORY AND REGULATORY PROVISIONS, AND BUSI-
    6  NESS  PRACTICES THAT LIMIT OPPORTUNITIES FOR MATURE WORKERS, AND DEVELOP
    7  LEGISLATIVE AND REGULATORY PROPOSALS TO ADDRESS SUCH LIMITATIONS;
    8    3. TO IDENTIFY BEST  PRACTICES  IN  THE  PRIVATE  SECTOR  FOR  HIRING,
    9  RETAINING AND RETRAINING MATURE WORKERS, AND SERVE AS A CLEARINGHOUSE OF
   10  SUCH INFORMATION;
   11    4.  TO ASSESS THE EFFECTIVENESS AND COSTS OF PROGRAMS THAT STATE AGEN-
   12  CIES HAVE IMPLEMENTED TO HIRE, RETAIN AND RETRAIN  MATURE  WORKERS,  AND
   13  RECOMMEND COST-EFFECTIVE PROGRAMS FOR ALL STATE AGENCIES TO HIRE, RETAIN
   14  AND RETRAIN OLDER WORKERS;
   15    5. TO MEET QUARTERLY OR MORE FREQUENTLY IF ITS BUSINESS SHALL REQUIRE;
   16    6. TO ANNUALLY REPORT TO THE GOVERNOR AND THE LEGISLATURE ON OR BEFORE
   17  JUNE  THIRTIETH COMMENCING IN TWO THOUSAND FOURTEEN, ITS RECOMMENDATIONS
   18  FOR STATE POLICY RELATING TO MATURE WORKERS, BEST PRACTICES IN THE BUSI-
   19  NESS SECTOR FOR HIRING, RETAINING AND RETRAINING MATURE WORKERS,  AND  A
   20  REVIEW  OF  SERVICES  INITIATED AND COORDINATED AMONG PUBLIC AND PRIVATE
   21  AGENCIES THAT MEET THE NEEDS OF OLDER WORKERS WHO ARE SEEKING TO  REMAIN
   22  ACTIVE IN THE WORKFORCE. SUCH REPORT SHALL IDENTIFY, IN CONJUNCTION WITH
   23  THE BUSINESS COMMUNITY, MATURE WORKER FRIENDLY BUSINESSES THAT ARE SEEK-
   24  ING  TO  HIRE AND/OR TRAIN WORKERS. THE REPORT REQUIRED BY THIS SUBDIVI-
   25  SION SHALL BE POSTED ON THE OFFICE FOR THE AGING'S INTERNET WEBSITE;
   26    7. TO SERVE AS THE FOCAL POINT  FOR  THE  DEVELOPMENT  OF  COORDINATED
   27  RESPONSES  BY THE VARIOUS STATE AGENCIES WITH REGARD TO ISSUES OF IMPOR-
   28  TANCE TO MATURE WORKERS TO ENSURE TIMELY AND  APPROPRIATE  RESPONSES  TO
   29  ISSUES AND PROBLEMS; AND
   30    8.  ANNUALLY  REPORT TO THE GOVERNOR, THE LEGISLATURE AND THE DIRECTOR
   31  OF THE OFFICE FOR THE AGING WITH AN ASSESSMENT OF THE  EFFECTIVENESS  OF
   32  THE  PROVISIONS  OF  THIS ARTICLE AND ANY BARRIERS OR OTHER ISSUES WHICH
   33  PREVENT THE TASK FORCE FROM CARRYING OUT ITS POWERS AND DUTIES  PURSUANT
   34  TO THIS ARTICLE.
   35    S  304.  IMPLEMENTATION. 1. THE OFFICE FOR THE AGING SHALL COLLABORATE
   36  WITH THE DEPARTMENT OF LABOR ON ISSUES RELATED  TO  THE  DEVELOPMENT  OF
   37  MATURE WORKER SUPPORT INITIATIVES AND ENHANCING ACCESS BY MATURE WORKERS
   38  TO  EXISTING TRAINING AND EMPLOYMENT SERVICES FUNDED THROUGH FEDERAL AND
   39  STATE RESOURCES.
   40    2. THE OFFICE FOR THE AGING SHALL UTILIZE  THE  DATA  AND  INFORMATION
   41  COMPILED  AND  MAINTAINED  BY  THE TASK FORCE TO COORDINATE STATE FUNDED
   42  RESEARCH AND EMPLOYMENT TRAINING EFFORTS TO ENSURE  THE  MOST  EFFICIENT
   43  USE OF FUNDS AVAILABLE FOR SUCH PURPOSES.
   44    S 3. This act shall take effect immediately.
