RIVERA, WEISENBERG -- read once and referred to the Committee on Aging AN ACT to amend the general business law, in relation to the sale of motor fuels to senior citizens THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Section 396-bb of the general business law, as added by 2 chapter 581 of the laws of 1990, subdivision 1 as amended by chapter 332 3 of the laws of 2000, is amended to read as follows: 4 S 396-bb. Sale of motor fuels to disabled persons AND SENIOR CITIZENS. 5 1. Any person, firm or corporation owning or operating a premises or 6 facility for the retail sale of motor fuels for use in motor vehicles 7 and offering self service and full service at the same time, shall, 8 between the hours of seven o'clock in the morning and seven o'clock in 9 the evening, provide full service of such motor fuels to disabled 10 persons with a valid New York state disabled person license plate AND 11 SENIOR CITIZENS at the same price charged for such motor fuels at the 12 self service islands and shall post a notice in a manner and in at least 13 one location which is conspicuous to a person seeking refueling service, 14 including a depiction of the international symbol of access and stating 15 as follows: 16 Full service at self service prices 17 7 a.m. to 7 p.m. 18 Such notice may also further state, 19 For persons with a valid New York state disabled license 20 plate AND SENIOR CITIZENS 65 OR OVER. 21 2. For purposes of this section: 22 (A) "disabled person" shall mean a registered owner or authorized 23 operator of a motor vehicle who has been issued special license tags by 24 the state; AND EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD02644-01-9 A. 5923 2 1 (B) "SENIOR CITIZEN" SHALL MEAN ANY PERSON SIXTY-FIVE YEARS OF AGE OR 2 OLDER AS EVIDENCED BY A LICENSE TO OPERATE A MOTOR VEHICLE. 3 3. Any violation of this section shall result in a civil fine of not 4 more than one hundred dollars to be collected by the corporation counsel 5 for any city or by the appropriate attorney of any political subdivision 6 as shall be designated by the governing body of such political subdivi- 7 sion. 8 S 2. This act shall take effect on the first of January next succeed- 9 ing the date on which it shall have become a law.
