        AN ACT to amend the environmental conservation law, in relation to test-
          ing of pesticides and other substances
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
     1    Section  1.  Title  24 of article 27 of the environmental conservation
     2  law is amended by adding a new section 27-2407 to read as follows:
     3  § 27-2407. Duty of the commissioner and department to test waste.
     4    Upon investigation of any complaint of a violation  of  this  article,
     5  the commissioner shall ensure that a test sample of any substance wrong-
     6  ly  exposed  to  a person shall be collected for purposes of identifica-
     7  tion. The commissioner shall immediately  disclose  to  the  person  any
     8  information  discovered during the investigation that may be relevant to
     9  such person's health and safety.
    10    § 2. Section 33-0303 of the environmental conservation law is  amended
    11  by adding a new subdivision 8 to read as follows:
    12    8. Upon investigation of any complaint of a violation of this article,
    13  the commissioner shall ensure that a test sample of any pesticide wrong-
    14  ly  exposed  to  a person shall be collected for purposes of identifica-
    15  tion. The commissioner shall immediately  disclose  to  the  person  any
    16  information  discovered during the investigation that may be relevant to
    17  such person's health and safety.
    18    § 3. Section 35-0107 of the environmental conservation law is  amended
    19  by adding a new subdivision 4 to read as follows:
    20    4. Upon investigation of any complaint of a violation of this article,
    21  the  commissioner  shall  ensure that a test sample of any detergent and
    22  any other household cleansing product wrongly exposed to a person  shall
    23  be  collected  for  purposes  of  identification. The commissioner shall
    24  immediately disclose to the person any information discovered during the
    25  investigation that may be relevant to such person's health and safety.

     1    § 4. Title 1 of article 37 of the environmental  conservation  law  is
     2  amended by adding a new section 37-0102 to read as follows:
     3  § 37-0102. Duty   of   the  commissioner  and  the  department  to  test
     4               substances.
     5    Upon investigation of any complaint of a violation  of  this  article,
     6  the commissioner shall ensure that a test sample of any substance wrong-
     7  ly  exposed  to  a person shall be collected for purposes of identifica-
     8  tion. The commissioner shall immediately  disclose  to  the  person  any
     9  information  discovered during the investigation that may be relevant to
    10  such person's health and safety.
    11    § 5. This act shall take effect on the ninetieth day  after  it  shall
    12  have become a law.
