          referred to the Committee on Correction
        AN  ACT  to  amend the correction law, in relation to the confinement of
          inmates under the age of eighteen
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
     1    Section  1.  The  opening paragraph of subdivision 6 of section 137 of
     2  the correction law, as amended by chapter 1 of  the  laws  of  2008,  is
     3  amended to read as follows:
     4    Except  as provided in paragraphs (d) and (e) of this subdivision, the
     5  superintendent of a correctional facility may  keep  any  inmate,  other
     6  than  inmates under the age of eighteen years who shall not be placed in
     7  segregated confinement for any reason, confined in a cell or room, apart
     8  from the accommodations provided for inmates who  are  participating  in
     9  programs  of the facility, for such period as may be necessary for main-
    10  tenance of order or discipline, but  in  any  such  case  the  following
    11  conditions shall be observed:
    12    § 2. This act shall take effect immediately.
