THIELE -- read once and referred to the Committee on Insurance AN ACT to amend the insurance law, in relation to providing coverage for biologically-based mental illness under the Healthy New York program THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Paragraphs 13 and 14 of subsection (d) of section 4326 of 2 the insurance law, as added by chapter 1 of the laws of 1999, are 3 amended and a new paragraph 15 is added to read as follows: 4 (13) blood and blood products furnished in connection with surgery or 5 inpatient hospital services; [and] 6 (14) prescription drugs obtained at a participating pharmacy. In addi- 7 tion to providing coverage at a participating pharmacy, health mainte- 8 nance organizations may utilize a mail order prescription drug program. 9 Health maintenance organizations may provide prescription drugs pursuant 10 to a drug formulary; however, health maintenance organizations must 11 implement an appeals process so that the use of non-formulary 12 prescription drugs may be requested by a physician[.]; AND 13 (15) PSYCHIATRIC OR PSYCHOLOGICAL SERVICES OR DIAGNOSIS OR TREATMENT 14 OF MENTAL, NERVOUS OR EMOTIONAL DISORDERS OR AILMENTS AND BIOLOGICALLY- 15 BASED MENTAL ILLNESS. 16 S 2.
