STATE OF NEW YORK ________________________________________________________________________ 8131 2019-2020 Regular Sessions IN ASSEMBLY June 3, 2019 ___________ Introduced by M. of A. BARRETT, ENGLEBRIGHT -- read once and referred to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to veteran access to free sport fishing days; and in relation to veteran access to free hunting, fishing, and trapping licenses The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 14 of section 11-0305 of the environmental 2 conservation law, as amended by section 24 of part EE of chapter 55 of 3 the laws of 2014, is amended to read as follows: 4 14. Notwithstanding any inconsistent provision of law, the commission- 5 er may designate no more than eight days in each year that shall be 6 effective in every administrative region of the department, as free 7 sport fishing days during which any person may, without having a sport 8 fishing license and without the payment of any fee, exercise the privi- 9 leges of a holder of a sport fishing license, subject to all of the 10 limitations, restrictions, conditions, laws, rules and regulations 11 applicable to the holder of a sport fishing license. Free sport fishing 12 days shall be designated in a manner determined by the department to 13 best provide public notice thereof and to maximize public participation 14 therein, so as to promote the recreational opportunities afforded by 15 sport fishing. No less than two of such free sport fishing days shall 16 prioritize access by veterans. 17 § 2. Subdivision 4 of section 11-0715 of the environmental conserva- 18 tion law, as amended by section 6 of part R of chapter 58 of the laws of 19 2013, is amended to read as follows: 20 4. A person, resident in the state for at least thirty days immediate- 21 ly prior to the date of application, who [has been honorably discharged22from service in the armed forces of the United States and certified as23having a forty percent or greater service-connected disability] is a 24 veteran, as defined in section three hundred fifty of the executive law, EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD13140-02-9A. 8131 2 1 is entitled to receive all licenses, privileges, tags, and permits 2 authorized by this title for which he or she is eligible, except turkey 3 permits, renewable each year [for a five dollar fee] free of charge. 4 § 3. This act shall take effect immediately.
