       AN ACT to amend the vehicle and traffic law, in  relation  to  requiring
         tow  truck  operators to light emergency flares when providing assist-
         ance on public highways, streets or roadways
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Short  title. This act shall be known and may be cited as
    2  "Todd's law".
    3    S 2. The vehicle and traffic law is amended by adding  a  new  section
    4  1224-a to read as follows:
    5    S  1224-A.  USE OF EMERGENCY FLARES BY TOW TRUCK OPERATORS. ANY PERSON
    6  OPERATING A TOW TRUCK AS DEFINED IN SECTION ONE HUNDRED FORTY-EIGHT-B OF
    7  THIS CHAPTER WHO IN THE REGULAR COURSE OF BUSINESS  PROVIDES  ASSISTANCE
    8  TO  A  DISABLED,  ILLEGALLY PARKED OR ABANDONED MOTOR VEHICLE OR A MOTOR
    9  VEHICLE INVOLVED IN AN ACCIDENT ON ANY HIGHWAY, STREET OR  ROADWAY  OPEN
   10  TO  PUBLIC MOTOR VEHICLE TRAFFIC, SHALL LIGHT A SERIES OF EMERGENCY ROAD
   11  FLARES EVERY ONE HUNDRED FEET BEGINNING APPROXIMATELY THREE HUNDRED FEET
   12  AWAY FROM THE REAR FENDER OF THE MOTOR VEHICLE REQUIRING  ASSISTANCE  UP
   13  TO THE FRONT FENDER OF THE TOW TRUCK. A VIOLATION OF THE REQUIREMENTS OF
   14  THIS  SECTION SHALL BE PUNISHABLE BY A FINE OF NOT LESS THAN TWO HUNDRED
   15  TWENTY-FIVE DOLLARS.
   16    S 3. This act shall take effect on the thirtieth day  after  it  shall
   17  have become a law.
