          tee on Judiciary

        AN ACT to amend the real property law, in relation to allowing  acknowl-
          edgments  and  proofs  by  any  officer in active service of the armed
          forces authorized to act as a notary

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  The opening paragraph of section 300 of the real property
     2  law, as amended by chapter 977 of the laws of 1962, is amended  to  read
     3  as follows:
     4    The  acknowledgment  or proof of a conveyance of real property situate
     5  in this state, if made by a person enlisted or commissioned in or  serv-
     6  ing  in  or with the armed forces of the United States or by a dependent
     7  of any such person, wherever located, or by  a  person  attached  to  or
     8  accompanying  the armed forces of the United States, whether made within
     9  or without the United States, may  be  made  before  any  [commissioned]
    10  officer in active service of the armed forces of the United States [with
    11  the rank of second lieutenant or higher in the Army, Air Force or Marine
    12  Corps,  or  ensign  or higher in the Navy or Coast Guard, or with equiv-
    13  alent rank] authorized to act as a notary in any [other] component  part
    14  of the armed forces of the United States.
    15    § 2. This act shall take effect immediately.
