        AN ACT to amend the economic development law, in relation to  establish-
          ing  the  minority  and  women-owned business enterprise center within
          empire state development corporation

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  The  economic  development law is amended by adding a new
     2  section 121 to read as follows:
     3    § 121. MWBE center. 1. As used in this section:
     4    a. "Director" means the director of the MWBE center  created  in  this
     5  section;
     6    b.  "MWBE" means an organization described in article fifteen-A of the
     7  executive law; and
     8    c. "Center" means the MWBE center created by this section.
     9    2. The minority and women-owned business enterprise (MWBE)  center  is
    10  hereby  created  within the empire state development corporation to have
    11  and exercise the functions, powers and duties provided by the provisions
    12  of this section and any other provision of law.
    13    3. The head of the center shall be the director.  The  director  shall
    14  receive  a  salary to be fixed by the governor within the amounts appro-
    15  priated therefor. The director  shall  report  to  the  commissioner  of
    16  empire state development.
    17    a.  The director may, from time to time, create, abolish, transfer and
    18  consolidate units not expressly established by law as the  director  may
    19  determine  necessary  for the efficient operation of the center, subject
    20  to the approval of the commissioner of empire state development.
    21    b. The director may appoint assistants, and other officers and employ-
    22  ees, committees and consultants as  the  director  may  deem  necessary,
    23  prescribe  their  powers  and  duties, fix their compensation within the
    24  amounts appropriated therefor, subject to the approval  of  the  commis-
    25  sioner of empire state development and the director of the budget.
    26    c. The director may request and receive from any department, division,
    27  board,  bureau,  commission or other agency of the state any information

     1  and non-financial resources that will  enable  the  center  to  properly
     2  carry out its functions, powers and duties. Requests for assistance from
     3  such  entities  shall  be subject to the approval of the commissioner of
     4  empire state development.
     5    4. The center shall have the following functions, powers and duties:
     6    a.  to make the services of the division of minority and women's busi-
     7  ness development accessible in-person in cities with a population of one
     8  million or more;
     9    b. to assist MWBE's in a city with a population of one million or more
    10  with accessible, in-person certification, business development,  capaci-
    11  ty-building, contract identification, and technical support;
    12    c.  to  provide  information  about existing federal, state, and local
    13  MWBE and business assistance programs;
    14    d. to  provide  education  relating  to  certification  and  licensure
    15  requirements; and
    16    e.  to periodically coordinate with agencies regarding the interpreta-
    17  tion and clarification of state regulations.
    18    5. On or before September thirtieth of each  year,  the  center  shall
    19  submit  a report to the commissioner of empire state development setting
    20  forth the following:
    21    a. the number of MWBEs accessing the center's services;
    22    b. aggregate information regarding the location and ownership  of  the
    23  businesses accessing the center's services;
    24    c.  aggregate  information regarding the types of services provided to
    25  businesses accessing the center's services;
    26    d. aggregate information regarding certifications and contracts won by
    27  businesses receiving assistance of the center; and
    28    e. recommendations of the center as to how to better serve MWBE  busi-
    29  nesses.
    30    § 2. This act shall take effect immediately.
