STATE OF NEW YORK ________________________________________________________________________ 10294 IN ASSEMBLY May 20, 2016 ___________ Introduced by M. of A. ROSENTHAL -- read once and referred to the Committee on Alcoholism and Drug Abuse AN ACT to amend the mental hygiene law, in relation to requiring certain persons providing substance abuse treatment on counseling to complete training in medication assisted treatment The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The mental hygiene law is amended by adding a new section 2 19.31 to read as follows: 3 § 19.31 Medication assisted treatment training requirement. 4 Every person who is a credentialed alcoholism and substance abuse 5 counselor pursuant to subdivision (d) of section 19.07 of this article 6 or a qualified health care professional who provides treatment or coun- 7 seling services at a substance use disorder facility, at a school or 8 pursuant to the Drug Addiction Treatment Act of 2000, shall, within 9 eighteen months of the effective date of this section or within one year 10 of commencing the provision of any such treatment or counseling, which- 11 ever shall be later, successfully complete a course of instruction 12 relating to medication assisted treatment approved by the office. 13 § 2. This act shall take effect on the first of January next succeed- 14 ing the date on which it shall have become a law. Provided, that effec- 15 tive immediately, the addition, amendment and/or repeal of any rule or 16 regulation necessary for the implementation of this act on its effective 17 date is authorized and directed to be made and completed on or before 18 such effective date.
