        AN ACT to amend the public health law, in relation to classifying  gaba-
          pentin as a controlled substance
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. Subdivision 2 of section 3371 of the public health  law  is
     2  amended by adding a new paragraph (d) to read as follows:
     3    (d)  For  purposes of this section, gabapentin shall be deemed to be a
     4  controlled substance.
     5    § 2. Subdivision 1 of section 3343-a  of  the  public  health  law  is
     6  amended by adding a new paragraph (e) to read as follows:
     7    (e)  For  purposes of this section, gabapentin shall be deemed to be a
     8  controlled substance.
     9    § 3. This act shall take effect on the first of January next  succeed-
    10  ing  the  date  upon which it shall have become a law; provided that the
    11  amendment to subdivision 2 of section 3371 of the public health law made
    12  by section one of this act shall survive the expiration and reversion of
    13  such section as provided in section 12 of chapter  90  of  the  laws  of
    14  2014,  as  amended.  Effective  immediately  the  addition, amendment or
    15  repeal of any rule or regulation necessary  for  the  implementation  of
    16  this  act  on  its effective date are authorized to be made on or before
    17  such date.
