       AN ACT to amend the education law, in relation to the use of tobacco  at
         state-operated institutions of the state university of New York
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Section 355 of the education law is amended by adding a new
    2  subdivision 20 to read as follows:
    3    20. THE FOLLOWING ARE PROHIBITED AT STATE-OPERATED INSTITUTIONS OF THE
    4  STATE UNIVERSITY OF NEW YORK:
    5    A. THE USE OF TOBACCO ON ALL GROUNDS AND FACILITIES OWNED,  LEASED  OR
    6  CONTROLLED  BY  THE  STATE UNIVERSITY OR ITS RELATED ENTITIES, INCLUDING
    7  INDOOR AND OUTDOOR LOCATIONS; AND
    8    B. THE USE OF TOBACCO IN VEHICLES OWNED OR LEASED BY THE STATE UNIVER-
    9  SITY OR ITS RELATED ENTITIES. FOR  PURPOSES  OF  THIS  SUBDIVISION,  THE
   10  "RELATED  ENTITIES"  OF  THE  STATE-OPERATED  INSTITUTIONS  OF THE STATE
   11  UNIVERSITY ARE THE FOUNDATIONS,  AUXILIARY  SERVICES  CORPORATIONS,  AND
   12  ALUMNI ASSOCIATIONS AND SUBSIDIARIES THEREOF.
   13    S 2. This act shall take effect September 1, 2012.
