STATE OF NEW YORK ________________________________________________________________________ 126 2017-2018 Regular Sessions IN SENATE (Prefiled) January 4, 2017 ___________ Introduced by Sen. HOYLMAN -- read twice and ordered printed, and when printed to be committed to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to prohibiting the sale and distribution of glyphosate and products containing glyphosate The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The environmental conservation law is amended by adding a 2 new section 37-0115 to read as follows: 3 § 37-0115. Prohibition of glyphosate and products containing glyphosate. 4 1. No person, firm, partnership, association, limited liability compa- 5 ny or corporation shall distribute, sell, offer for sale or use glypho- 6 sate or any products containing glyphosate within New York state. 7 2. For the purposes of this section, glyphosate shall mean a synthetic 8 compound that is a non-selective systemic herbicide, also known as 9 N-(phosphonomethyl) glycerine with a chemical formula of C3H8NO5P. 10 3. The department is authorized to promulgate such rules and regu- 11 lations as it shall deem necessary to implement the provisions of this 12 section. 13 § 2. This act shall take effect one year after it shall have become a 14 law; provided, however, that effective immediately, the addition, amend- 15 ment and/or repeal of any rule or regulation necessary for the implemen- 16 tation of this act on its effective date is authorized and directed to 17 be made and completed on or before such effective date.
