        AN ACT in relation to the definition of safety-net providers

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  Notwithstanding any provision of law to the contrary, for
     2  the purposes of determining if a provider can  evince  severe  financial
     3  distress  as outlined by chapter 53 of the laws of 2022 making appropri-
     4  ations for the support of government, the  department  of  health  shall
     5  consider  criteria  including  but  not limited to a general hospital as
     6  defined by section 2801 of the public  health  law  that:  (a)  has  two
     7  months, or less, worth of reserves to cover anticipated expenses; (b) is
     8  an  enhanced  safety  net  hospital  as defined by section 2807-c of the
     9  public health law; (c) is at risk of defaulting on existing  debt  obli-
    10  gations; or (d) needs to undergo a major capital improvement in order to
    11  maintain  existing  services  that  the  general  hospital cannot obtain
    12  financing for and does not have reserves to cover the cost of such capi-
    13  tal improvement.
    14    § 2.  This act shall take effect on the   same   date   and   in   the
    15  same  manner   as   chapter 53 of the laws of 2022 making appropriations
    16  for the support of government, takes effect.
