ADAMS -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend the executive law, in relation to fees charged by certain fire departments for motor vehicle fires and accidents THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. The executive law is amended by adding a new section 159-d 2 to read as follows: 3 S 159-D. APPROVAL FOR FEES. NOTWITHSTANDING ANY OTHER PROVISION OF 4 LAW, NO FIRE DEPARTMENT LOCATED IN A CITY WITH A POPULATION OF ONE 5 MILLION OR MORE SHALL CHARGE A FEE FOR SERVICES PROVIDED IN RESPONSE TO 6 A MOTOR VEHICLE FIRE OR MOTOR VEHICLE ACCIDENT UNLESS SUCH FIRE DEPART- 7 MENT OBTAINS APPROVAL FROM THE OFFICE OF FIRE PREVENTION AND CONTROL TO 8 CHARGE SUCH FEE. SUCH APPROVAL SHALL BE OBTAINED BY APPLICATION TO SUCH 9 OFFICE IN A MANNER AND FORM PRESCRIBED BY SUCH OFFICE. 10 S 2. This act shall take effect on the sixtieth day after it shall 11 have become a law; provided, however, that effective immediately, the 12 addition, amendment and/or repeal of any rule or regulation necessary 13 for the implementation of this act on its effective date is authorized 14 to be made and completed on or before such date.
