        Introduced  by  Sens.  GOUNARDES,  COMRIE,  GIANARIS,  HOYLMAN, JACKSON,
          KRUEGER, MYRIE, RIVERA, SALAZAR, SEPULVEDA, STAVISKY -- read twice and
          ordered printed, and when printed to be committed to the Committee  on
          Transportation

        AN  ACT  to amend the vehicle and traffic law, in relation to creating a
          pedestrian safety rating system for motor vehicles

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  The  vehicle  and  traffic law is amended by adding a new
     2  section 216-b to read as follows:
     3    § 216-b. Pedestrian safety rating system for motor vehicle models.  1.
     4  The  commissioner  shall  cause to be created a pedestrian safety rating
     5  system for every motor vehicle model registered by individuals  in  this
     6  state  which shall be made publicly available on the department's inter-
     7  net website. Such pedestrian safety rating system shall provide a rating
     8  between one and five stars for every motor vehicle model based on:
     9    (a) the frequency of collisions and number and  severity  of  injuries
    10  resulting  from  such  collisions involving a bicyclist or pedestrian as
    11  reported in the state for such motor  vehicle  model,  compared  to  the
    12  total number of such motor vehicle model registered in the state;
    13    (b)  safety  features that the commissioner determines are relevant to
    14  pedestrian and bicyclist safety, including but not limited to, automatic
    15  collision warning or pedestrian detection features,  automatic  braking,
    16  and visibility; and
    17    (c)  any  other  factors  the  commissioner determines are relevant to
    18  pedestrian and bicyclist safety.
    19    2. The commissioner shall  issue  regulations  to  all  motor  vehicle
    20  manufacturers,  dealers, brokers, distributors, and other business enti-
    21  ties required to register in section four hundred fifteen of this  arti-
    22  cle  to  require  such  entities  to  adopt the pedestrian safety rating

     1  system prescribed in subdivision one of this section  at  such  entity's
     2  place of business. Such entities shall be required to conspicuously post
     3  the pedestrian safety rating of between one and five stars on each motor
     4  vehicle advertised for sale at the place of business.
     5    §  2.  This  act shall take effect immediately; provided, however that
     6  the pedestrian safety rating system described in section  216-b  of  the
     7  vehicle  and  traffic  law  as added by section one of this act shall be
     8  finalized by the commissioner within six months of the effective date of
     9  this act.
