STATE OF NEW YORK ________________________________________________________________________ 912 2019-2020 Regular Sessions IN SENATE January 9, 2019 ___________ Introduced by Sens. YOUNG, ADDABBO, FUNKE, GALLIVAN, HELMING, O'MARA, SEWARD -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to the implementation of an electronic death registration system The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivisions 1 and 5 of section 4148 of the public health 2 law, as added by chapter 352 of the laws of 2013, are amended to read as 3 follows: 4 1. The department is hereby authorized and directed to design, imple- 5 ment and maintain an electronic death registration system for collect- 6 ing, storing, recording, transmitting, amending, correcting and authen- 7 ticating information, as necessary and appropriate to complete a death 8 registration, and to generate such documents as determined by the 9 department in relation to a death occurring in this state. As part of 10 the design and implementation of the system established by this section, 11 the department shall consult with all persons authorized to use such 12 system to the extent practicable and feasible. The payment referenced in 13 subdivision five of this section shall be collected for each burial or 14 removal permit issued, provided such burial or removal permit is issued 15 electronically, on or after the effective date of this section from the 16 licensed funeral director or undertaker to whom such permit is issued 17 through the electronic death registration system, in the manner speci- 18 fied by the department and shall be used solely for the purpose set 19 forth in subdivision five of this section. Except as specifically 20 provided in this section, the existing general duties of, and remunera- 21 tion received by, local registrars in accepting and filing certificates 22 of death and issuing burial and removal permits pursuant to any statute 23 or regulation shall be maintained, and not altered or abridged in any 24 way by this section. Licensed funeral directors and undertakers shall support the estab- 2 lishment and maintenance of the electronic death registration system 3 through a payment, tendered for each burial and removal permit issued, 4 provided such burial or removal permit is issued electronically, to a 5 licensed funeral director or undertaker through the electronic death 6 registration system, in the amount of twenty dollars, provided that such 7 payment shall be considered a cost of operation and the funeral director 8 or undertaker shall not charge any additional fee related to such 9 payment for funeral or other services. 10 § 2. This act shall take effect immediately.
