STATE OF NEW YORK ________________________________________________________________________ 919 2023-2024 Regular Sessions IN SENATE January 9, 2023 ___________ Introduced by Sen. COONEY -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to authorizing certain emergency medical technicians and paramedics to administer certain vaccines pursuant to non-patient specific orders and under the authority of an emergency medical services director The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The public health law is amended by adding a new section 2 3005-c to read as follows: 3 § 3005-c. Vaccination by emergency medical technicians and paramedics. 4 1. Emergency medical technicians and advanced emergency medical techni- 5 cians may administer vaccinations against influenza and COVID-19 pursu- 6 ant to a non-patient specific order and under the authority of an emer- 7 gency medical services director while overseen or approved by the 8 department of health or local health departments and operated under the 9 medical supervision of licensed physicians, licensed physician assist- 10 ants, or certified nurse practitioners; provided that such individuals 11 first receive training in the following areas, as determined by the 12 commissioner after consultation with the commissioner of education: 13 (a) techniques, indications, precautions, contraindications, infection 14 control practices; 15 (b) use of personal protective equipment sufficient to provide the 16 basic level of competence for such tasks; and 17 (c) a current certificate in basic cardiopulmonary resuscitation, 18 which at a minimum must include a certification in basic cardiopulmonary 19 resuscitation by an online program that has received accreditation from 20 the American Nurses Credentialing Center, the Accreditation Council for 21 Pharmacy Education (ACPE), or the Accreditation Council for Continuing 22 Medical Education. Certified emergency medical technician-paramedics, with prior 2 approval of the department, may administer vaccinations against influen- 3 za and COVID-19 pursuant to a non-patient specific order and under the 4 medical direction of a licensed physician; provided that such emergency 5 medical technician-paramedics first receive training in the following 6 areas, as determined by the commissioner after consultation with the 7 commissioner of education: 8 (a) techniques, indications, precautions, contraindications, infection 9 control practices; 10 (b) use of personal protective equipment sufficient to provide the 11 basic level of competence for such tasks; and 12 (c) a current certificate in basic cardiopulmonary resuscitation, 13 which at a minimum must include a certification in basic cardiopulmonary 14 resuscitation by an online program that has received accreditation from 15 the American Nurses Credentialing Center, the Accreditation Council for 16 Pharmacy Education (ACPE), or the Accreditation Council for Continuing 17 Medical Education. 18 § 2. This act shall take effect immediately.
