STATE OF NEW YORK ________________________________________________________________________ 924 2023-2024 Regular Sessions IN SENATE January 9, 2023 ___________ Introduced by Sen. COONEY -- read twice and ordered printed, and when printed to be committed to the Committee on Corporations, Authorities and Commissions AN ACT to amend part U of chapter 57 of the laws of 2005 amending the labor law and other laws relating to implementing the state fiscal plan for the 2005-2006 state fiscal year, in relation to the New York state higher education capital matching grant board The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 3 of section 1 of part U of chapter 57 of the 2 laws of 2005 amending the labor law and other laws relating to imple- 3 menting the state fiscal plan for the 2005-2006 state fiscal year, as 4 added by section 1 of part D of chapter 63 of the laws of 2005, is 5 amended by adding a new paragraph (b-1) to read as follows: 6 (b-1) Within amounts appropriated therefor, the board is hereby 7 authorized and directed to award matching capital grants totaling two 8 million dollars for projects to implement, modify, or otherwise enhance 9 cyber security infrastructure. The public college sector and the college 10 sector shall each be eligible to receive grants totaling not more than 11 one million dollars. Each public college and college shall be eligible 12 for a grant award amount as determined by calculations pursuant to 13 subdivision five of this section. In addition, such public colleges and 14 colleges shall be eligible to compete for additional funds pursuant to 15 paragraph (h-1) of subdivision four of this section. 16 § 2. Subdivision 4 of section 1 of part U of chapter 57 of the laws of 17 2005 amending the labor law and other laws relating to implementing the 18 state fiscal plan for the 2005-2006 state fiscal year, as added by 19 section 1 of part D of chapter 63 of the laws of 2005, is amended by 20 adding a new paragraph (h-1) to read as follows: 21 (h-1) If a public college or college does not apply for a grant by 22 March thirty-first, two thousand twenty-seven, funds associated with EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD02626-01-3S. 924 2 1 such potential grant shall be awarded, on a competitive basis, to other 2 public colleges or colleges. Public colleges shall be eligible to apply 3 for unutilized public college grants within their respective systems and 4 colleges shall be eligible to apply for unutilized college grants. The 5 dormitory authority shall develop a request for proposals and applica- 6 tion process, in consultation with the board, for such grants and shall 7 develop criteria, subject to review by the board, for the awarding of 8 such grants. Such criteria shall incorporate the matching criteria 9 contained in paragraph (c) of this subdivision, and the application 10 criteria set forth in paragraph (e) of this subdivision. The dormitory 11 authority shall require all applications in response to the request for 12 proposals to be submitted by September first, two thousand twenty-seven, 13 and the board shall act on each application for such matching grants by 14 November first, two thousand twenty-seven. 15 § 3. This act shall take effect immediately.
