STATE OF NEW YORK ________________________________________________________________________ 1061 2023-2024 Regular Sessions IN SENATE January 9, 2023 ___________ Introduced by Sen. MAY -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend the education law, in relation to required training for school district officers The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 1 of section 2102-a of the education law, as 2 amended by chapter 388 of the laws of 2010, is amended to read as 3 follows: 4 1. a. Every trustee or voting member of a board of education of a 5 school district or a board of cooperative educational services, elected 6 or appointed for a term beginning on or after July first, two thousand 7 five, shall, within the first year of his or her term, complete a mini- 8 mum of six hours of training on the financial oversight, accountability 9 and fiduciary responsibilities of a school board member. 10 b. In addition to the training required by paragraph a of this subdi- 11 vision, every trustee or voting member of a board of education of a 12 school district or a board of cooperative educational services, elected 13 or appointed for a [first] term beginning on or after the first of July 14 next succeeding the effective date of this paragraph, shall, within the 15 first year of his or her term, complete a training course to acquaint 16 him or her with the powers, functions and duties of boards of education, 17 including, but not limited to, responsibility for adoption of curriculum 18 and instructional materials for courses of study required under this 19 chapter, and responsibility for adoption of curriculum and instructional 20 materials aligned with all New York state learning standards, as well as 21 the powers and duties of other governing and administrative authorities 22 affecting public education. Such training shall include any new or 23 updated laws, rules or regulations relevant to the requirements of this 24 subdivision. [Upon demonstration of compliance, no trustee or member of a board2of education or a board of cooperative educational services shall be3required to repeat the training requirements provided for in paragraphs4a and b of this subdivision.] Nothing in this section shall be deemed to 5 require a member of a central high school district board or a member of 6 a board of cooperative educational services to complete such require- 7 ments if such member has already completed such requirements as a member 8 of a board of a component school district. [Nothing in this section9shall be deemed to require trustees or voting members of a board of10education of a school district or a board of cooperative educational11services to complete the requirements of paragraph b of this subdivision12if such trustee or member is seated or appointed on or before the effec-13tive date of the chapter of the laws of two thousand ten that amended14this subdivision.] 15 § 2. This act shall take effect immediately.
