STATE OF NEW YORK ________________________________________________________________________ 2719 2017-2018 Regular Sessions IN SENATE January 17, 2017 ___________ Introduced by Sen. HAMILTON -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend the executive law, in relation to the reporting of demo- graphic data The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The executive law is amended by adding a new section 170-c 2 to read as follows: 3 § 170-c. Reporting of demographic data. 1. Every state agency, board, 4 or commission that directly or by contract reports demographic data 5 resulting from any inspections or pending cases it authorizes or penal- 6 ties it imposes, shall base such disaggregated data on race, gender and 7 region. 8 2. The demographic data collected pursuant to subdivision one of this 9 section shall be included in every report resulting from any 10 inspections, pending cases or penalties by the state agency, board, or 11 commission published or released on or after July first, the calendar 12 year following the effective date of this section. The data shall be 13 made available to the public in accordance with state and federal law, 14 except for personal identifying information, which shall be deemed 15 confidential, by posting such data on the internet website of the agency 16 on or before July first, the calendar year following the effective date 17 of this section, and annually thereafter. This subdivision shall not be 18 construed to prevent any other state agency from posting data collected 19 pursuant to subdivision one of this section on the agency's website, in 20 the manner prescribed by this section. 21 § 2. This act shall take effect on the one hundred twentieth day after 22 it shall have become a law. EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted.
