       Introduced  by  Sens. DeFRANCISCO, LARKIN, RANZENHOFER -- read twice and
         ordered printed, and when printed to be committed to the Committee  on
         Codes
       AN  ACT  to amend the penal law, in relation to expanding the definition
         of health care provider relating to sex offenses
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Subdivision 12 of section 130.00 of the penal law, as added
    2  by chapter 1 of the laws of 2000, is amended to read as follows:
    3    12.  "Health care provider" means any person who is, or is required to
    4  be, licensed or registered  or  holds  himself  or  herself  out  to  be
    5  licensed  or  registered,  or  provides  services  as  if he or she were
    6  licensed or registered in  the  profession  of  medicine,  chiropractic,
    7  dentistry  [or],  NURSING,  podiatry  OR  X-RAY TECHNOLOGY OR RADIOLOGIC
    8  TECHNOLOGY under any of the following: article one  hundred  thirty-one,
    9  one   hundred   thirty-two,   one   hundred  thirty-three,  ONE  HUNDRED
   10  THIRTY-NINE or one hundred forty-one of the  education  law  OR  ARTICLE
   11  THIRTY-FIVE OF THE PUBLIC HEALTH LAW.
   12    S 2. This act shall take effect on the first of November next succeed-
   13  ing the date on which it shall have become a law.
