STATE OF NEW YORK ________________________________________________________________________ 3484 2019-2020 Regular Sessions IN SENATE February 7, 2019 ___________ Introduced by Sen. CARLUCCI -- read twice and ordered printed, and when printed to be committed to the Committee on Social Services AN ACT to amend part C of chapter 60 of the laws of 2014, amending the social services law and other laws relating to eliminating prescriber prevails for brand name drugs with generic equivalents, in relation to the establishment of a developmental disability clinician advisory group by the commissioner of health The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 18 of part C of chapter 60 of the laws of 2014, 2 amending the social services law and other laws relating to eliminating 3 prescriber prevails for brand name drugs with generic equivalents, is 4 amended to read as follows: 5 § 18. The commissioner of health [is authorized to] shall establish a 6 developmental disability clinician advisory group of experienced clini- 7 cians and clinic administrators who have an understanding of the compre- 8 hensive needs of people with developmental disabilities. Such group 9 shall provide the commissioner and the department of health with infor- 10 mation and data on the effect of policies, including proposed regu- 11 lations or statutes, and of fiscal proposals, including rate setting and 12 appropriations, on the delivery of supports and services for individuals 13 with developmental disabilities including but not limited to the role of 14 specialty services. Such group shall consist of the following persons or 15 their designees: the commissioner of the office for people with develop- 16 mental disabilities, the commissioner of the department of health, three 17 individuals appointed by the governor, two individuals each by the 18 temporary president of the senate and by the speaker of the assembly. 19 The members of the group shall be appointed for a term of two years and 20 shall meet at least three times in each full calendar year during the 21 first two years and additionally upon the request of the commissioner of 22 the department of health. This act shall take effect immediately; provided, however, that 5 any appointments pursuant to section one of this act shall be made with- 6 in 180 days from such effective date.
