       Introduced by Sen. PANEPINTO -- read twice and ordered printed, and when
         printed to be committed to the Committee on Education
       AN ACT to amend the education law, in relation to teacher certification
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Section 3004 of the education law is amended  by  adding  a
    2  new subdivision 7 to read as follows:
    3    7.  THE  COMMISSIONER SHALL NOT REQUIRE THAT ANY APPLICANT FOR CERTIF-
    4  ICATION BE REQUIRED TO  TAKE  AN  EXAMINATION  ADMINISTERED  BY  PEARSON
    5  EDUCATION, INC. OR ANY OF ITS AFFILIATES TO QUALIFY FOR A CERTIFICATION,
    6  LICENSE,  PROBATIONARY  PERIODS,  APPOINTMENT, AND TENURE OF POSITION OF
    7  PERSONS EMPLOYED IN THE TEACHING, OR  SUPERVISING  SERVICE.  NOTHING  IN
    8  THIS  SUBDIVISION  SHALL  BE  CONSTRUED  AS TO REMOVE THE ABILITY OF THE
    9  COMMISSIONER TO ADMINISTER OTHER TESTS AS PART OF  THE  TEACHER  CERTIF-
   10  ICATION PROCESS.
   11    S  2.  This  act  shall  take  effect  on  the first of September next
   12  succeeding the date on which it shall have become a law.
