       Introduced  by Sen. GALLIVAN -- read twice and ordered printed, and when
         printed to be committed to the Committee on Crime Victims,  Crime  and
         Correction -- committee discharged, bill amended, ordered reprinted as
         amended and recommitted to said committee
       AN  ACT to amend the executive law, in relation to the powers and duties
         of the chairman of the board of parole
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Subdivision  3  of section 259-b of the executive law, as
    2  amended by section 38-a of subpart A of part C of chapter 62 of the laws
    3  of 2011, is amended to read as follows:
    4    3. The governor shall designate one of the members  of  the  board  as
    5  chairman  to  serve  in such capacity at the pleasure of the governor or
    6  until the member's term of office expires and a successor is  designated
    7  in  accordance  with  law, whichever first occurs. THE CHAIRMAN SHALL BE
    8  RESPONSIBLE FOR THE ADMINISTRATIVE FUNCTIONS AND DAILY OPERATIONS OF THE
    9  PAROLE BOARD AND ITS STAFF, EXCEPT AS OTHERWISE PROVIDED BY LAW.
   10    S 2. This act shall take effect immediately.
