       Introduced  by  Sen.  SAVINO -- read twice and ordered printed, and when
         printed to be committed to the Committee on Cities
       AN ACT relating to party boats in Sheepshead Bay
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.    (a)  No  person  operating  a party boat near or around
    2  Sheepshead Bay shall knowingly cause, make, allow  or  permit  a  public
    3  noise disturbance to originate from the vessel, including but not limit-
    4  ed to:
    5    (1)  the  frequent,  repetitive  or continuous sounding of any horn or
    6  siren, except as a warning of danger or  as  specifically  permitted  or
    7  required by law;
    8    (2)  the  creation  of  frequent,  repetitive  or continuous sounds in
    9  connection with the starting, operation, repair, rebuilding, testing  or
   10  revving  of  vessel engines as to unreasonably disturb or interfere with
   11  the peace and comfort of others, including owners and possessors of real
   12  property;
   13    (3) sound from any audio sound system operated at volumes so as to  be
   14  audible greater than fifty feet from the watercraft itself; or
   15    (4)  any  other  sound that unreasonably interferes with the peace and
   16  comfort of others.
   17    (b) Notwithstanding any provision of law to the  contrary,  no  person
   18  shall  operate, anchor or secure a party boat within seven hundred fifty
   19  feet of the shore of Sheepshead  Bay  or  within  one  hundred  feet  of
   20  Sheepshead Bay dock.
   21    (c)  For  purposes  of  this section party boat means a vessel that is
   22  fourteen feet in length or longer, measured from end  to  end  over  the
   23  deck;  operated  by the owner of the vessel or an employee of the owner;
   24  and rented or leased  by  the  owner  for  a  group  recreational  event
   25  consisting of more than six passengers.
   26    (d) The provisions of this act shall not apply to fishing boats.
   27    S 2. This act shall take effect immediately.
