        Introduced  by  Sen. VALESKY -- read twice and ordered printed, and when
          printed to be committed to the Committee on Education
        AN ACT to amend the education  law,  in  relation  to  the  city  school
          district of the city of Syracuse
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. Subdivision 1 of section  3635  of  the  education  law  is
     2  amended by adding a new paragraph h to read as follows:
     3    h.  Notwithstanding  any  other  provision of law to the contrary, the
     4  city school district of the city of Syracuse, pursuant to adoption of  a
     5  resolution  by  the  board  of education setting forth a plan, may enter
     6  into a pilot program not to exceed five school years  beginning  in  the
     7  two  thousand  seventeen--two  thousand  eighteen school year to provide
     8  transportation  services  for  children  residing  within  the  district
     9  attending kindergarten through grade five who live one mile or more from
    10  the  school they legally attend. Such transportation shall be restricted
    11  to transportation to and from children's homes or before or after-school
    12  child care locations and, if offered, shall be provided for each student
    13  up to a distance of fifteen miles, provided, however that the  board  of
    14  education  of  the  city  school district may approve transportation for
    15  children who live within one mile from the school they legally attend if
    16  such transportation is necessary due to safety concerns.  Transportation
    17  pursuant  to  this paragraph shall be offered equally to all children in
    18  like circumstances residing in the district.  For the purpose of comput-
    19  ing approved transportation expenses for  transportation  aid,  expenses
    20  for   transportation  provided  pursuant  to  this  paragraph  shall  be
    21  included. The city school district  of  the  city  of  Syracuse    shall
    22  provide  a  report  to  the  governor,  the speaker of the assembly, the
    23  temporary president of the senate and the commissioner on the results of
    24  the first four years of the pilot program, including the cost and  bene-
    25  fit  analysis  of  increased  or decreased costs for the the city school

     1  district and the state, and the impact on student attendance and academ-
     2  ic performance of the school district, on or before September fifteenth,
     3  two thousand twenty-one.
     4    § 2. This act shall take effect immediately.
