       Introduced  by  Sens.  RITCHIE,  FUNKE, GRIFFO -- read twice and ordered
         printed, and when printed to be committed to the Committee on Finance
       AN ACT to amend the executive law and the agriculture and  markets  law,
         in relation to police training regarding animal cruelty and protection
         laws
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Paragraph (k) of subdivision 1 of section 840 of the execu-
    2  tive law, as added by chapter 492 of the laws of  2009,  is  amended  to
    3  read as follows:
    4    (k)  Development,  maintenance and dissemination, IN CONSULTATION WITH
    5  THE DEPARTMENT OF AGRICULTURE  AND  MARKETS,  of  written  policies  and
    6  procedures  pursuant  to  ANIMAL CRUELTY AND PROTECTION LAWS, INCLUDING,
    7  BUT NOT LIMITED TO, article twenty-six of the  agriculture  and  markets
    8  law,  section  352.3  of the family court act as it applies to companion
    9  animals, and applicable provisions  of  the  penal  law,  regarding  the
   10  investigation  and  prevention  of  any  act of cruelty to animals.  THE
   11  COUNCIL SHALL MAKE PROVISIONS IN SUCH POLICIES AND  PROCEDURES  FOR  THE
   12  EDUCATION  AND  TRAINING  IN  ENFORCEMENT  OF  SUCH  ANIMAL  CRUELTY AND
   13  PROTECTION LAWS.
   14    S 2. Section 837 of the executive law  is  amended  by  adding  a  new
   15  subdivision 20 to read as follows:
   16    20.  TO ASSIST THE DEPARTMENT OF AGRICULTURE AND MARKETS IN DEVELOPING
   17  INFORMATION ABOUT ANIMAL CRUELTY AND PROTECTION LAWS PURSUANT TO  SUBDI-
   18  VISION  FORTY-EIGHT  OF  SECTION  SIXTEEN OF THE AGRICULTURE AND MARKETS
   19  LAW.
   20    S 3. Section 16 of the agriculture  and  markets  law  is  amended  by
   21  adding a new subdivision 48 to read as follows:
   22    48. MAKE AVAILABLE IN WRITTEN AND ELECTRONIC MEDIUM, IN A MANNER READ-
   23  ILY  ACCESSIBLE  TO POLICE AGENCIES AND OFFICERS AND DISTRICT ATTORNEYS,
   24  INFORMATION ABOUT ANIMAL CRUELTY AND PROTECTION LAWS  IN  THIS  CHAPTER,
        EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
                             [ ] is old law to be omitted.

    1  INCLUDING,  BUT  NOT LIMITED TO, ARTICLE TWENTY-SIX OF THIS CHAPTER. THE
    2  DEVELOPMENT OF SUCH INFORMATION SHALL BE COORDINATED WITH  THE  DIVISION
    3  OF  CRIMINAL  JUSTICE  SERVICES, INCLUDING THE MUNICIPAL POLICE TRAINING
    4  COUNCIL,  IN  A  MANNER DESIGNED TO ENHANCE TRAINING OF MUNICIPAL POLICE
    5  OFFICERS AND TO ASSIST SUCH OFFICERS AND DISTRICT ATTORNEYS IN ENFORCING
    6  AND APPLYING SUCH LAWS.
    7    S 4. This act shall take effect immediately.
