MAZIARZ -- read twice and ordered printed, and when printed to be committed to the Committee on Judiciary AN ACT to amend the uniform city court act, in relation to judges of the city courts in the city of Lockport and to repeal certain provisions of the judiciary law relating thereto THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Paragraph 27 of subdivision (d) of section 2104 of the 2 uniform city court act, as amended by chapter 493 of the laws of 2006, 3 is amended to read as follows: 4 27 Lockport, [one] TWO full-time [and one part-time]; 5 S 2. The opening paragraph of subparagraph (iii) of paragraph 1 of 6 subdivision (e) of section 2104 of the uniform city court act, as 7 amended by chapter 493 of the laws of 2006, is amended to read as 8 follows: 9 by the mayor of the city for which the court on which he or she will 10 serve has been established: part-time city court judge of Binghamton, 11 city court judges of Cohoes, part-time city court judge of Dunkirk, 12 part-time city court judge of Fulton, city court judge of Geneva who 13 serves in the office that formerly was that of acting city court judge 14 of Geneva, city court judge of Hornell who serves in the office that 15 formerly was that of acting city court judge of Hornell, city court 16 judge of Hudson who serves in the office that formerly was that of 17 acting city court judge of Hudson, part-time city court judge of King- 18 ston, part-time city court judge of Lackawanna, city court judge of 19 Little Falls who serves in the office that formerly was that of acting 20 CITY court judge of Little Falls, [part-time city court judge of Lock- 21 port], city court judge of Mechanicville who serves in the office that 22 formerly was that of acting city court judge of Mechanicville, part-time 23 city court judge of Middletown, part-time city court judge of Mount 24 Vernon, part-time city court judge of New Rochelle and full-time city EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD11512-01-1 S. 5466 2 1 court judge of such city who serves in the office created during the 2 calendar year commencing January first, two thousand one, part-time city 3 court judge of North Tonawanda, part-time city court judge of Ogdens- 4 burg, city court judge of Oneida who serves in the office that formerly 5 was that of acting city court judge of Oneida, city court judge of 6 Oneonta who serves in the office that formerly was that of acting city 7 court judge of Oneonta, part-time city court judge of Oswego, city court 8 judges of Poughkeepsie, city court judge of Rensselaer who serves in the 9 office that formerly was that of acting city court judge of Rensselaer, 10 part-time city court judge of Saratoga Springs, part-time city court 11 judge of Tonawanda and city court judge of Watervliet who serves in the 12 office that formerly was that of acting city court judge of Watervliet. 13 Provided, however, the following special provisions shall be applicable 14 in the city of Poughkeepsie: 15 S 3. The 49th unnumbered clause of section 221-i of the judiciary law 16 is REPEALED. 17 S 4. Transition. (a) Upon the effective date of this act, the position 18 of part-time judge of the Lockport city court shall be abolished and be 19 replaced by a full-time judgeship. Any person serving in the position 20 abolished hereby on the date of its abolition shall continue in service 21 in the full-time judgeship that replaces it until the thirty-first day 22 of December next following the date on which such term of office would 23 otherwise expire. 24 (b) Upon the first occurrence of a vacancy in the office of full-time 25 city court judge of the city of Lockport established by subdivision (a) 26 of this section, the office shall be filled by election for a term 27 commencing the first day of January next after the election. 28 S 5. This act shall take effect on the first day of April next 29 succeeding the date on which it shall have become a law.
