STATE OF NEW YORK ________________________________________________________________________ 5713 2019-2020 Regular Sessions IN SENATE May 13, 2019 ___________ Introduced by Sen. PERSAUD -- read twice and ordered printed, and when printed to be committed to the Committee on Social Services AN ACT to amend the social services law, in relation to state supplement payments and personal needs allowance for eligible individuals receiv- ing enhanced residential care The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Paragraph (c) of subdivision 1 of section 131-o of the 2 social services law, as amended by section 1 of part L of chapter 56 of 3 the laws of 2019, is amended to read as follows: 4 (c) in the case of each individual receiving enhanced residential 5 care, an amount equal to at least: 6 (i) $204.00 for each month beginning on or after January first, two 7 thousand nineteen; 8 (ii) $223.00 for each month beginning on or after April first, two 9 thousand twenty; 10 (iii) $243.00 for each month beginning on or after January first, two 11 thousand twenty-one; 12 (iv) $262.00 for each month beginning on or after January first, two 13 thousand twenty-two; 14 (v) $281.00 for each month beginning on or after January first, two 15 thousand twenty-three; and 16 (vi) $300.00 for each month beginning on or after January first, two 17 thousand twenty-four. 18 § 2. Paragraph (e) of subdivision 2 of section 209 of the social 19 services law, as amended by section 2 of part L of chapter 56 of the 20 laws of 2019, is amended to read as follows: 21 (e) [On and after] (i)(1) From January first, two thousand nineteen to 22 March thirty-first, two thousand twenty, [(i)] for an eligible individ- 23 ual receiving enhanced residential care, $1,465.00; and [(ii)] (2) for 24 an eligible couple receiving enhanced residential care, two times the EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD10403-04-9S. 5713 2 1 amount set forth in [subparagraph (i)] clause one of this [paragraph] 2 subparagraph. 3 (ii)(1) From April first, two thousand twenty to December thirty- 4 first, two thousand twenty, for an eligible individual receiving 5 enhanced residential care, $1,484.00; and (2) for an eligible couple 6 receiving enhanced residential care, two times the amount set forth in 7 clause one of this subparagraph. 8 (iii)(1) From January first, two thousand twenty-one to December thir- 9 ty-first, two thousand twenty-one, for an eligible individual receiving 10 enhanced residential care, $1,504.00; and (2) for an eligible couple 11 receiving enhanced residential care, two times the amount set forth in 12 clause one of this subparagraph. 13 (iv) (1) From January first, two thousand twenty-two to December thir- 14 ty-first, two thousand twenty-two, for an eligible individual receiving 15 enhanced residential care, $1,523.00; and (2) for an eligible couple 16 receiving enhanced residential care, two times the amount set forth in 17 clause one of this subparagraph. 18 (v) (1) From January first, two thousand twenty-three to December 19 thirty-first, two thousand twenty-three, for an eligible individual 20 receiving enhanced residential care, $1,542.00; and (2) for an eligible 21 couple receiving enhanced residential care, two times the amount set 22 forth in clause one of this subparagraph. 23 (vi) (1) From January first, two thousand twenty-four to December 24 thirty-first, two thousand twenty-four, for an eligible individual 25 receiving enhanced residential care, $1,561.00; and (2) for an eligible 26 couple receiving enhanced residential care, two times the amount set 27 forth in clause one of this subparagraph. 28 § 3. This act shall take effect on the same date and in the same 29 manner as sections 1 and 2 of part L of chapter 56 of the laws of 2019, 30 takes effect.
