STATE OF NEW YORK ________________________________________________________________________ 5762 2021-2022 Regular Sessions IN SENATE March 18, 2021 ___________ Introduced by Sen. BRESLIN -- read twice and ordered printed, and when printed to be committed to the Committee on Insurance AN ACT to amend the insurance law, in relation to removing certain requirements for independent insurance adjuster licenses The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Paragraph 3 of subsection (d) of section 2108 of the insur- 2 ance law, as renumbered by section 1 of subpart F of part II of chapter 3 55 of the laws of 2019, is amended to read as follows: 4 (3) [Such] Except in the case of an application for a license to act 5 as an independent adjuster, such application shall be approved, as to 6 each person or individual so signing the same, by not less than five 7 reputable citizens of the community in which such applicant resides or 8 transacts business, each of whom shall certify that he or she has 9 personally known the person or individual for a period of at least five 10 years prior to the filing of such application, that he or she has read 11 such application and believes each of the statements made therein to be 12 true, that such person is honest, of good character and competent, and 13 not related or connected to the person so certifying by blood or 14 marriage. The certificate of approval shall be subscribed by such 15 reputable citizens and affirmed by them as true under the penalties of 16 perjury. 17 § 2. This act shall take effect immediately.
