S T A T E O F N E W Y O R K ________________________________________________________________________ 5814 2011-2012 Regular Sessions I N S E N A T E June 17, 2011 ___________ Introduced by COMMITTEE ON RULES -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the education law, in relation to requiring providers of prekindergarten services to employ a licensed childhood or early childhood teacher as the on-site education director; and to amend chapter 57 of the laws of 2008 amending the education law relating to the universal pre-kindergarten program, in relation to the effective- ness thereof THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Paragraphs d-1 and d-2 of subdivision 12 of section 3602-e 2 of the education law, as added by section 23 of part B of chapter 57 of 3 the laws of 2008, are amended to read as follows: 4 d-1. guidelines which allow personnel employed by an eligible agency 5 that is collaborating with a school district to provide prekindergarten 6 services and licensed by an agency other than the department, to meet 7 the staff qualifications prescribed by the licensing or registering 8 agency; provided however, [a written plan is established for prekinder- 9 garten teachers to obtain a certificate valid for service in early 10 childhood grades within five years after commencing employment, or by 11 January third, two thousand thirteen, whichever is later] THAT THE AGEN- 12 CY OPERATING SUCH PROGRAM SHALL EMPLOY AN ON-SITE EDUCATION DIRECTOR 13 DURING THE HOURS THAT THE PREKINDERGARTEN PROGRAM IS IN OPERATION THAT 14 WILL BE RESPONSIBLE FOR PROGRAM IMPLEMENTATION, WHO SHALL POSSESS A 15 TEACHING LICENSE OR CERTIFICATE VALID FOR SERVICES IN THE EARLY CHILD- 16 HOOD OR CHILDHOOD GRADES; 17 d-2. guidelines which allow personnel employed by an eligible agency 18 that is collaborating with a school district to provide prekindergarten 19 services and not licensed or registered by the department or other agen- 20 cy, to meet the staff qualifications prescribed by such eligible agency; 21 provided however, [a written plan is established for prekindergarten EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. Subdivision 4 of section 51 of part B of chapter 57 of the laws 10 of 2008 amending the education law relating to the universal pre-kinder- 11 garten program, as amended by chapter 2 of the laws of 2011, is amended 12 to read as follows: 13 4. section 23 of this act shall take effect July 1, 2008 [and shall 14 expire and be deemed repealed June 30, 2012]; 15 S 3. This act shall take effect immediately.
