       Introduced by Sens. FUSCHILLO, MARCELLINO, MARTINS, SKELOS -- read twice
         and ordered printed, and when printed to be committed to the Committee

       AN  ACT  to  amend the executive law, in relation to extending access to
         criminal information
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Subdivision  9  of  section  835 of the executive law, as
    2  amended by section 102 of subpart B of part C of chapter 62 of the  laws
    3  of 2011 and as further amended by section 104 of part A of chapter 62 of
    4  the laws of 2011, is amended to read as follows:
    5    9.  "Qualified agencies" means courts in the unified court system, the
    6  administrative board of the judicial conference, probation  departments,
    7  sheriffs'  offices, district attorneys' offices, the state department of
    8  corrections and community supervision, the department of  correction  of
    9  any municipality, the insurance frauds bureau of the state department of
   10  financial  services,  the  office of professional medical conduct of the
   11  state department of health for the purposes of section two hundred thir-
   12  ty of the public health law, the child protective  services  unit  of  a
   13  local social services district when conducting an investigation pursuant
   14  to  subdivision  six  of  section four hundred twenty-four of the social
   15  services law, the office of Medicaid inspector  general,  the  temporary
   16  state commission of investigation, the criminal investigations bureau of
   17  the  department  of  financial  services,  police forces and departments
   18  having responsibility for enforcement of the general  criminal  laws  of
   19  the  state [and], the Onondaga County Center for Forensic Sciences Labo-
   20  ratory when acting within the scope of its law  enforcement  duties  AND
   21  THE NASSAU COUNTY MEDICAL EXAMINER'S OFFICE WHEN ACTING WITHIN THE SCOPE
   22  OF ITS LAW ENFORCEMENT DUTIES.
   23    S 2. This act shall take effect immediately.
