       Introduced  by Sen. CARLUCCI -- read twice and ordered printed, and when
         printed to be committed to the Committee on Transportation
       AN ACT to amend the vehicle and traffic law, in relation to motor  vehi-
         cle repair shop exclusions
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Paragraph (d) of subdivision 2  of  section  398-b  of  the
    2  vehicle  and traffic law, as amended by chapter 212 of the laws of 1980,
    3  is amended and a new paragraph (e) is added to read as follows:
    4    (d) any person solely engaged in the business  of  repairing  farm  or
    5  road  building  machines,  or such other utility vehicles as the commis-
    6  sioner may by regulation designate[.]; OR
    7    (E) ANY PERSON OR ENTITY WHOSE ACTIVITIES PRIMARILY CONSIST OF RESTOR-
    8  ING, REBUILDING OR CUSTOMIZING SPECIALTY MOTOR VEHICLES OR  MOTOR  VEHI-
    9  CLES AT LEAST TWENTY-FIVE YEARS OLD.
   10    S  2.  This  act  shall take effect on the sixtieth day after it shall
   11  have become a law.
