STATE OF NEW YORK ________________________________________________________________________ 6995 2023-2024 Regular Sessions IN SENATE May 16, 2023 ___________ Introduced by Sens. WEBER, ROLISON -- read twice and ordered printed, and when printed to be committed to the Committee on Veterans, Home- land Security and Military Affairs AN ACT to amend the executive law, in relation to authorizing a county, city, town or village to override a state disaster emergency in all or part of the territorial limits of such local government The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 28 of the executive law is amended by adding a new 2 subdivision 6 to read as follows: 3 6. A county, city, town or village may, at any time, limit or super- 4 sede a governor's declaration of a disaster emergency by executive order 5 issued under this section, by issuing a local state of emergency and 6 local emergency orders under section twenty-four of this article. The 7 local state of emergency and local emergency orders shall only effect 8 part or all of the territorial limits of such local government. 9 § 2. Section 29-a of the executive law is amended by adding a new 10 subdivision 5 to read as follows: 11 5. A county, city, town or village may, at any time, limit or super- 12 sede a governor's declaration of a disaster emergency by executive 13 order issued under this section, by issuing a local state of emergency 14 and local emergency orders under section twenty-four of this article. 15 The local state of emergency and local emergency orders shall only 16 effect part or all of the territorial limits of such local government. 17 § 3. This act shall take effect immediately and shall apply to any 18 executive order issued by the governor on or after January 1, 2023.
