          printed to be committed to the Committee on Finance
        AN  ACT to amend the executive law, in relation to designating the Clav-
          erack Creek, the Taghkanic Creek and the Agawamuck Creek as  parts  of
          the inland waterway system
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. Subdivision 4 of section  911  of  the  executive  law,  as
     2  amended  by chapter 133 of the laws of 2012, paragraph (a) as separately
     3  amended by chapters 92 and 97 of the laws  of  2015,  paragraph  (b)  as
     4  separately  amended  by  chapters  95, 96 and 97 of the laws of 2015 and
     5  paragraph (c) as amended by chapter 98 of the laws of 2015,  is  amended
     6  to read as follows:
     7    4.  "Inland  waterways"  shall mean (a) the state's major inland lakes
     8  consisting of lakes Ballston, Big Tupper, Black,  Campfire,  Canadarago,
     9  Canandaigua,  Cayuga,  Champlain, Chateaugay, Chautauqua, Conesus, Cran-
    10  berry, Echo (in the county of  Westchester),  George,  Great  Sacandaga,
    11  Honeoye,  Indian, Keuka, Long, Mirror, Oneida, Onondaga, Otisco, Otsego,
    12  Owasco,  Peach,  Placid,  Raquette,  Ronkonkoma,  Sacandaga,   Saratoga,
    13  Schroon,  Seneca,  Skaneateles,  Silver  (in  the county of Wyoming) and
    14  Saranac, and the Fulton chain of lakes; (b)  the  state's  major  rivers
    15  comprised  of  the Allegheny, Ausable, Battenkill, Black, Boquet, Bronx,
    16  Canisteo, Chaumont (including Chaumont bay),  Chemung,  Cohocton,  Dela-
    17  ware,  Deer,  Genesee,  Grasse, Great Chazy, Hoosic, Hudson north of the
    18  federal dam at Troy, Indian, Little (in  the  Adirondack  park),  Little
    19  Ausable,  Little  Salmon  (including  north  and  south  branches), Mad,
    20  Mettowee, Mohawk, Oswegatchie, Pocantico, Racquette, Sacandaga,  Salmon,
    21  Saranac,  Saw  Mill,  Schroon, Susquehanna, Tioga, Tioughnioga, Wallkill
    22  and Buffalo rivers, and the north  and  middle  branches  of  the  Moose
    23  river;  (c)  the  state's  major  creeks  comprised of the 18 Mile Creek
    24  located in Erie county, Bushkill, Cattaraugus,  Cincinnati,  East  Kill,
    25  Esopus  (including  upper  and lower branches), Fish (including east and
    26  west branches), Gooseberry, Little Sandy,  Onondaga,  Sandy,  Schoharie,
    27  South  Sandy,  Oatka, Tonawanda, West Kill, Scajaquada, Wappinger [and],
         EXPLANATION--Matter in italics (underscored) is new; matter in brackets
                              [ ] is old law to be omitted.

     1  Wynantskill, Claverack, Taghkanic and Agawamuck;  (d)  the  Barge  Canal
     2  System  as defined in section two of the canal law; and (e) the adjacent
     3  shorelands to the extent that such inland waters and adjacent lands  are
     4  strongly  influenced  by  each  other  including,  but  not  limited to,
     5  islands, wetlands, beaches, dunes, barrier islands, cliffs,  bluffs  and
     6  erosion prone areas.
     7    § 2. This act shall take effect immediately.
