STATE OF NEW YORK ________________________________________________________________________ 7708 2023-2024 Regular Sessions IN SENATE October 16, 2023 ___________ Introduced by Sen. LIU -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the tax law and the vehicle and traffic law, in relation to exempting commuter vans from congestion pricing in New York city The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 1299 of the tax law is amended by adding a new 2 subdivision (h) to read as follows: 3 (h) "Commuter van" shall have the same meaning as such term is defined 4 pursuant to subdivision p of section 19-502 of the administrative code 5 of the city of New York. 6 § 2. Section 1299-a of the tax law is amended by adding a new subdivi- 7 sion (c-1) to read as follows: 8 (c-1) Notwithstanding the foregoing, the surcharge imposed by this 9 article shall not apply to transportation services provided by commuter 10 vans, as such term is defined pursuant to section twelve hundred nine- 11 ty-nine of this article. 12 § 3. The vehicle and traffic law is amended by adding a new section 13 1704-b to read as follows: 14 § 1704-b. Exemption from central business district tolling program. 15 Any owner or operator of a commuter van, as such term is defined pursu- 16 ant to section twelve hundred ninety-nine of the tax law, while in the 17 course of operating such commuter van for the purposes of transporting 18 passengers, shall not be charged for entry into or remaining in the 19 central business district pursuant to section seventeen hundred four-a 20 of this article. 21 § 4.
