       AN ACT to amend the criminal procedure  law,  in  relation  to  advanced
         training in motor vehicle tactics for the state police
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. The criminal procedure law  is  amended  by  adding  a  new
    2  section 2.40 to read as follows:
    3  S 2.40 ADVANCED TRAINING IN MOTOR VEHICLE TACTICS FOR THE STATE POLICE.
    4    1.  THE  SUPERINTENDENT  OF THE STATE POLICE, IN CONSULTATION WITH THE
    5  COMMISSIONER OF MOTOR VEHICLES, SHALL DESIGN AND IMPLEMENT A PROGRAM  OF
    6  ADVANCED TRAINING IN MOTOR VEHICLE TACTICS TO IMPROVE THE DRIVING SKILLS
    7  AND  PROFICIENCIES  OF  TROOPERS  FOR THE VARIETY OF DRIVING CONDITIONS,
    8  ENVIRONMENTS AND SCENARIOS LIKELY TO BE FACED BY A TROOPER IN THE COURSE
    9  OF HIS OR HER REGULAR DUTIES AND RESPONSIBILITIES.
   10    2. ON OR BEFORE THE FIFTEENTH OF DECEMBER, THE SUPERINTENDENT  OF  THE
   11  STATE  POLICE SHALL PRODUCE AN ANNUAL REPORT TO THE GOVERNOR, THE TEMPO-
   12  RARY PRESIDENT OF THE SENATE AND THE SPEAKER  OF  THE  ASSEMBLY  ON  THE
   13  ADVANCED  TRAINING  IN  MOTOR  VEHICLE TACTICS PROGRAM ESTABLISHED UNDER
   14  THIS SECTION. SUCH REPORT SHALL DETAIL AND INCLUDE THE  DEVELOPMENTS  OF
   15  THE PROGRAM, AS WELL AS AN ASSESSMENT OF ITS IMPLEMENTATION, MAINTENANCE
   16  AND EFFECTIVENESS.
   17    S  2.  In  order  to facilitate the advanced training in motor vehicle
   18  tactics program established pursuant to section one  of  this  act,  the
   19  commissioner  of  general  services shall acquire from the Seneca County
   20  Industrial Development Agency, the real property  known  as  the  Seneca
   21  Army  Airfield,  together  with  such  other  surrounding property as is
   22  necessary or advisable within the judgment of such commissioner and  the
   23  superintendent  of  the state police, in order to implement and maintain
   24  such program. Such real property acquired for this purpose shall  there-
   25  after  serve  as  a location for such advanced training in motor vehicle
   26  tactics for the division of the state police, and any other law enforce-
   27  ment entity or state agency that the superintendent of state police  may
   28  approve  to  use such facility. The commissioner of general services, in

    1  consultation with such superintendent, shall  direct  such  upgrades  to
    2  such  real  property and facilities at the Seneca Army Airfield, and the
    3  construction or renovation of accompanying buildings or  facilities,  as
    4  may  be  required  for the implementation and maintenance of an advanced
    5  training in motor vehicle  tactics  program,  in  accordance  with,  and
    6  pursuant  to,  any  necessary  future  budgetary appropriations for such
    7  purpose.
    8    S 3. This act shall take effect immediately.
