STATE OF NEW YORK ________________________________________________________________________ 7749 IN SENATE February 13, 2020 ___________ Introduced by Sen. AKSHAR -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to authorize the town of Union in the county of Broome to convey to New York State Electric & Gas, an easement through land located in the town's West Endicott Park to be used to convey an existing over- head electrical transmission line and anchoring facilities The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The town of Union in the county of Broome, acting by and 2 through its town board, is hereby authorized to convey by appropriate 3 instruments to New York State Electric & Gas, an easement in West Endi- 4 cott Park described in section three of this act, for the purpose of 5 enabling the existing electric transmission structure number 48 of elec- 6 tric transmission line number 353 to be relocated within the existing 7 easement and appropriate anchoring facilities be installed east of said 8 relocated structure and shall restore the surface of the lands and the 9 lands shall continue to be used for park purposes. 10 § 2. The authorization provided in section one of this act shall be 11 effective only upon the condition that the town of Union in the county 12 of Broome dedicate an amount equal to or greater than the fair market 13 value of the easement interest being alienated pursuant to section one 14 of this act to the acquisition of new parklands and/or capital improve- 15 ments to existing park and recreational facilities. 16 § 3. The easement to be conveyed by the town of Union in the county of 17 Broome pursuant to the provisions of this act is described as follows: 18 All that tract or parcel of land being situate in the Town of Union, 19 County of Broome and State of New York; being bounded and described as 20 follows: 21 Beginning at a point on the northerly bounds of Maple Street, said 22 point being North 79°48'40" East a distance of 58.82 feet from the 23 intersection of said northerly bounds of Maple Street and the easterly 24 bounds of Mills Avenue; running thence along an Easement Line through 25 the lands of Town of Union (L 1091, P 51) the following eight courses 26 and distances: EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD14943-01-0S. 7749 2 1 1) North 24°54'39" East 59.35 feet; 2 2) North 07°22'38" West 17.76 feet; 3 3) North 82°37'22" East 50.00 feet; 4 4) South 07°22'38" East 21.65 feet; 5 5) South 81°39'21" East 36.85 feet; 6 6) South 08°20'39" West 20.00 feet; 7 7) North 81°39'21" West 36.90 feet; 8 8) South 24°54'39" West 28.46 feet; 9 to a point on the aforementioned northerly bounds of Maple Street; 10 running thence South 79°48'40" West along said northerly bounds a 11 distance of 61.11 feet to the point of beginning. Containing 0.101 acre 12 of land. Bearings refer to True North. 13 Subject to easements of record. 14 Subject to the rights of the public over Maple Street. 15 § 4. The conveyance of the easement authorized by the provisions of 16 this act shall not occur until the town of Union in the county of Broome 17 has complied with any federal requirements pertaining to the alienation 18 or conversion of parklands, including satisfying the secretary of the 19 interior that the alienation or conversion complies with all conditions 20 which the secretary of the interior deems necessary to assure that the 21 substitution of other lands be equivalent in fair market value and 22 recreational usefulness to the lands being alienated or converted. 23 § 5. This act shall take effect immediately.
