STATE OF NEW YORK ________________________________________________________________________ 8232 IN SENATE April 27, 2020 ___________ Introduced by Sen. BROOKS -- read twice and ordered printed, and when printed to be committed to the Committee on Consumer Protection AN ACT to amend the general business law, in relation to price gouging associated with the novel coronavirus, COVID-19 emergency The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 396-r of the general business law is amended by 2 adding a new subdivision 5 to read as follows: 3 5. When a court has determined that a violation has occurred for 4 price gouging associated with the novel coronavirus, COVID-19 emergency, 5 any company, corporation, association, partnership, limited liability 6 company, individual, business or location shall be subject to the 7 following restrictions: 8 (a) shall not qualify for any economic relief or support programs 9 associated with economic relief provided by or to the state of New York 10 as a result of the novel coronavirus, COVID-19; 11 (b) shall not apply for any contracts with the state for a period of 12 five years; 13 (c) shall, effective March thirty-first, two thousand twenty, have any 14 state or local program and benefits rescinded in which it is currently 15 participating and receiving a reduction in property taxes, sales tax 16 relief or a payment in lieu of taxes; and 17 (d) shall not participate in any industrial development agency 18 programs for a five-year period. 19 § 2.
